As a nurse, what does liability insurance cover? Does it cover both the legal cost of related to the suit and the settlement cost? Or does it only cover one of them?
Answer: Liability isn't standardized, the way you're implying. There are all different KINDS of liability. Each liability policy can work a different way.
For malpractice coverage, which is maybe what you're talking about, defense costs are usually INSIDE the limits. That means, defense costs are covered, UNTIL you hit your policy limit. The MOST the policy pays. for legal fees, settlement, or judgement, is the TOTAL amount of the policy limit.
Most general liability policies (think slip and fall coverage) have the defense costs OUTSIDE the limit - they don't get added in to count against you.

Professional Liability Insurance For A Nursing Assistant?
Question by belle | Posted in Health Care
Does anyone know if I'm supposed to carry insurance? Or if my employer should? Thank you!
Answer: As far as liability insurance is concerned the answer is as always...it depends. Normally you are covered by the employer. THat being said, if you do not establish that you are covered, they may not cover you. Make sure you establish who is paying for your liability coverage from the beginning.
However, as a practical point... there is very little responsiblity on the MA, as ther job is always assumed to be under the direction of the Nurse/Doctor. In over 30 years working in healthcare, I have never seen an MA named in a medical liability suit. The returns are too small. In other words, they will always go for the deep pockets. As an MA you might be covered for up to $100,000
What Does "aggregate" Mean In The Insurance Industry?
Question by chocolatelover | Posted in Insurance
I am looking to purchase professional liability insurance for myself (I'm a nurse). It says 1,000,000 per claim/6,000,000 aggregate. What does the $6million aggregate mean? Also, I have heard that there is an insurance for nurses that will cover you years later. Eg: If you have coverage for 2006-2008 and then in 2009 no longer have coverge but get sued in 2010 for an incident in 2007, the insurance will still cover the incident because you were covered at that time. Do you know of this?
Answer: It usually refers to Liability Insurance and indicates the amount of coverage that the insured has under the contract for a specific period of time, usually the contract period, no matter how many separate accidents may occur. Basically they will pay 1M per claim but even if you have 100 claims for 100M they will pay just 6M total no penny more. Most insurance will protect you for claims which originated during the time you were covered. Usually state statue gives time limit for filling of the claims.
