Would "TORT Reform" Be As Successful As Michigan's "No-Fault" Insurance Law?
Question by Subject 2 Change | Posted in Politics
No-Fault insurance in Michigan was designed to do away with frivolous lawsuits, but now the courts in Michigan are filled with people suing their own insurance companies to "pay-up" on the premiums they've collected upon.
Is "that" the "TORT Reform" we have to look forward to - If the GOP were to "walk the walk" for a change?
Answer: We have had 'Tort Reform' in California for more than 10 years. I had not impact on insurance prices, not health insurance, not automobile insurance, not malpractice insurance and not Workman's Comp insurance. As a matter of fact it made things miserable for people who are injured on the job. The workers comp insurance gets ordered by a judge to pay the benefits, then a few month later they thumb their nose at the judge and stop the benefits. Go do a search on Nataline Sarkisyan. What Is Work Loss Benefit (PIP) For Homemaker Under Michigan No-fault Insurance Law?
Question by Bjorn Johnson | Posted in Insurance & Registration
Michigan is a no fault insurance state. They force you to have medical and work loss coverage in the event of an accident taking away your health or an ability to work. You can coordinate with existing medical or work loss (disability) insurance to save money.
Does anyone know if there are any mandates set for work loss benefits for a homemaker? The law forces me to carry work loss benefits for my wife, who is a homemaker and receives no income, however, it feels to me like I am paying premiums on coverage from which we would never - God forbid - receive any benefit.
Answer: MI PIP is funky and different than any other state out there.
I suggest you contact your agent and pose this question to them. Or call your insurance company and ask to talk to a PIP adjuster. The adjuster with their experience can state what coverage she may or may not get due to her being a homemaker.

Is There A Law In Michigan Requiring Parents To Add 18 Year Olds To Their Auto Insurance Policy?
Question by subhash s | Posted in Insurance
Answer: If you are considering not notifying your insurance company about your kids who have driver licenses and live in your household, don't go there. What you are doing is committing a material misrepresentation about the policy. This can allow your company to void coverage for losses under certain cases. It isn't worth the risk.
How Do I Calculate The Interest My Insurance Company Owes Me On My Claim Under Michigan.law?
Question by James | Posted in Insurance
My property claim was referred to a third party appraisal process by State Farm. Under Michigan Law if there is a difference between what the insurance company paid at the beginning of the claim and what is awarded, the insurance company must pay interest on the difference. The Umpire made an award that was significantly greater than State Farm's estimate but now State Farm is claiming their interest liability is limited by the initial estimate of a contractor done before the claim was referred to appraisal and before the full cost of the repairs was known and recognized by the umpire. Can anyone help me with the rules/law/ case reference to fight back and get the full interest award?
Answer: I couldn't find anything in a quick search, but I can tell from the way you worded it, that it's not correct.
Anyway. A quick phone call to a public adjuster should give you your fast answer. You could also likely call your state insurance commissioner's office, and get a super dead on accurate answer within 24 business hours.
The REASON why this is incorrect, is the "what the insurance company paid at the beginning".
It's not - it's "what the loss was assessed for at the beginning". The initial check you received, would have the deductible subtracted out, AND it would have a depreciation holdback until the repairs are complete,
