Question About The HIPPA (Health Insurance Portability And Accountability Act Of 1996)?

im 20 years old & just recently left my parents' CONTROLING household.i wanted 2 get a check up & be put on birthcontrol with out my parents knowing. well my aunt works at my doctors office & i went 2 get a PAP smear, pelvic exam, & be put on the depo shot. i had all my mail sent 2 my friend (who went with me) address & used the friends home phone number. so if word got back to my parents i knew my aunt is who told. what do i do if & when she tells? how do i go about fileing complaints on her? what does the HIPPA say i can do to her for violating federal laws on privacy?

Answer: The Supreme Court ruling in the first answer is COMPLETELY WRONG! People 17 and over have the rights. Anyone under the age of 17 needs parental consent. ANYTHING...ANYONE. Parents have the rights to know of certain things regarding children.

How does it work in conjunction with COBRA?


Answer: There are 2 Federal laws that protect people in every single state in the US that face difficulty in getting and keeping health insurance coverage.

The 2 laws are the HIPAA laws and the COBRA laws.

In a nutshell as long as someone does the responsible thing and tries to keep their health insurance coverage for as long as they can then if they lose the coverage due to reasons beyond their own control then the COBRA and HIPAA laws step in and mandate guaranteed issue coverage that covers all pre-existing conditions.

Are People In The Same Insurance Policies Exempt From HIPPA Laws?

I am under my dad's policy still. Is he eligible to obtain my medical records from the doctors I go to?


Answer: No as a medical provider i can not share your medical information with anyone with out your expressed consent to include those on the same policy such as a spouse, the only exception being the parents of a minor child.

Answer: The HIPAA laws dictate that if you are eligible for a HIPAA guaranteed issue individual health insurance plan then all pre-existing conditions are covered.

There are 6 requirements that you must meet in order to be eligible for a HIPAA plan. Once you meet those requirements then you will be guaranteed coverage and that coverage will cover all pre existing conditions.

HIPPA With Employer Insurance.?

Yesterday I received phone call from my insurance carrier. My husband is primary insurance holder. He is getting insurance from him employer. The lady from insurance company was saying she wants to talk with me something related to Hippa. I am confused if I have coverage from an employer why does my precondition comes in picture?Any help is really appreciated.

Answer: Because you're just coming ON to the new group policy, so in order for your preexisting condition to be covered, you'll need to provide them with a certificate of credible coverage from your prior insurance company, which was cancelled LESS THAN 63 days before this one starts.

Unless your preexisting condition is pregnancy, in which case it's covered anyway.
