Home Insurance - Difference Between Medical Payment And Liability?
Question by zephyrs | Posted in Insurance
Home owner insurance - On my Personal Liability Schedule, I saw these:
L - Personal Liabilty, $500,000 each occurance
M - Medical payments $1,000 each person, $25,000 each accident
What is the difference between personal liablity and medical payments? If someone slipped and injured in my yard, does that consider medical payment or liabilty?
Thank you so much for your help!
Answer: Liability, is when someone sues you for damage you cause somehow. It provides your defense lawyer, and any judgement, for a covered loss. They have to prove that you are LIABLE. Usually, that means negligent in some way.
Medical payments is a NO FAULT coverage. It's a small amount, but you don't have to be LIABLE. It pays medical payments only, for ANY injury happening on your premises, to a non-resident. So, they get smart and fall down your stairs while showing off and doing a cartwheel. Med pay will pay up to $1,000 for doctor bills. But if they want more, they'd have to sue you, and prove that you pushed them.
If someone slips in your yard, and they
Advice On Responsibility For Medical Insurance Payment.?
Question by Weixi | Posted in Insurance
Basically, my wife got bit by a stranger's dog. I took her to the emergency room, and additionally had a police report filed.
My understanding is that the hospital or our insurance company is supposed to go after the stranger for payment. Instead... the hospital charged everything to my medical insurance (Anthem Blue Cross) and Blue Cross paid for it.
The end result is I get a bill to pay $300 for the remainder, which I don't think I should be paying.
At this point I'm wondering what I should do to avoid paying for something that the stranger should be responsible for:
1) Call stranger and ask for $300... doubt this will work. If
Answer: Your understanding is wrong. When you go to the hospital, YOU are responsible to pay for the services you receive. Period. YOUR insurance has the option of trying to subrogate - going against the other person, or their insurance, IF THEY WANT TO. They don't have an obligation to do this, it is their option.
Certainly you can ask the stranger for the $300. They might say no, in which case you can sue them.
Your medical insurance is NOT going to charge back the payment to the hospital, and you can't demand the hospital put the bill on this other guy's account - any more than *I* can have my medical bills charged to YOU. It doesn't work that way.
What Type Of Insurance Pays Out First Medical Payment Or Liability?
Question by Nickolas Felsh | Posted in Insurance
Medical Payments vs. Liability Insurance
Answer: Well, it depends WILDLY on what type of policy you're talking about.
But let's assume auto.
Med pay is a FIRST PARTY coverage, you have to collect under your own policy. Any "no fault" state, will require you to collect under your med pay first.
Liability, regardless of policy type, is always a THIRD PARTY coverage. You "collect" under the other person's policy, assuming their insurer agrees that THEIR driver is liable for your damages. It can take a very, very long time, for the liability part of the claim to be settled - they're going to wait until you are as recovered as you possibly can get.
Car Insurance; Medical Treatment Payment To Passengers?
Question by Lucia Fernoaar | Posted in Insurance & Registration
I got in an accident with a third party and im getting covered all the payments by the third party. There were three other passengers with me in my car and now we all are getting the medical treatment.
We will be getting the treatment for awhile. I know that i will be getting the checks from the insurance company after the treatment is done.
However, im not sure if the passengers are getting the checks from the insurance as well and how much percentage they get.
Am i be able to gonna get their checks to me? since im the one whos been paying all the insurance fee?
Please please let me know. thanks for your time!
Answer: The checks will be for the exact amount of the medical expenses incurred. They will either go to the individual involved or to the medical provider. If the check is sent to the individual, they will then be responsible to pay their medical bills. Any further settlement (for other than medical expenses) would go to the claimant
