If the government puts a cap on medical malpractice insurance and law suites, would that drive costs down? How ethical would it be, and do you think the Democrats and Republicans would let such a bill pass? No hate answers please and this question will be put to a vote. Thanks in advance for answering..
Answer: I thought some states already had a cap. We voted on that issue in Nevada years ago and it did not lower medical costs at all. It did bring out the worst of the worst doctors in the city. We have some horrible clinics, doctors and to top it off health inspectors. An entire clinic of thousands of people were exposed to Hepatitis C last year. My mother and several other seniors had fake surgeries where they went under anesthesia and woke up, told the surgery was successful only to find out 6 months later nothing was ever done. I'm happy with generalities, but if anyone has info specific to NY, that'd be helpful. I am curious really about two things: (1) Do doctors typically carry separate insurance beyond what is covered under the hospital's insurance policy? (2) Does the hospital provide a separate policy for each individual doctor or clinic, or is it one big pool for the whole hospital?
I am aware of a situation in which a hospital's insurance is about to be expended, but there are ongoing claims against individual doctors.
Answer: If the doctor is an employee of the hospital, they do not have their own coverage. If they are NOT an employee of the hospital, they do have their own coverage.
The hospital has their own malpractice policy, which includes blanket coverage for all employees - so one pool for the whole hospital.

Answer: Doctors are not leaving the field because of malpractice premiums, they are leaving because government reimbursement for heathcare is less than the cost to provide the service. Costs for employees and supplies rise every year and the government decreases reimbursement every year.
